Building Permit Overview

A Building Permit is a legal document issued by a Registered Building Surveyor confirming that your proposed building work complies with the Building Act 1993, Building Regulations 2018, and the National Construction Code of Australia. This approval is required before commencing most types of construction, renovation, extension, or demolition work.

What Does a Building Surveyor Do?

Building Surveyors are qualified professionals responsible for:

Once engaged, we:

  3. Issue the Building Permit once all documentation is satisfactory
Engaging the Right Practitioner
When installing a new swimming pool or spa, the work must be carried out by a builder who is registered in the appropriate category or class for this type of construction. Property owners may choose to act as an owner‑builder; however, for work valued over $16,000, a Certificate of Consent from the Building Practitioners Board (BPC) is required.

A building permit is required before installing a pool, spa, or safety barrier unless the proposed work is exempt. The property owner must appoint a registered building surveyor—either private or municipal—to assess the documentation and issue the building permit.

In addition to a building permit, some projects may require a planning permit or other approvals. Owners should confirm any local requirements with their relevant council.

A complete building permit application must include:

  • Detailed drawings and specifications for the proposed pool, spa, safety barrier, and water recirculation/filtration systems
  • Documentation demonstrating compliance with the National Construction Code (NCC) and relevant Australian Standards.
  • A list of all building practitioners involved in preparing the documentation
  • Construction of the pool, spa, or safety barrier must commence within 12 months of the permit issue date.
  • Once work has started, it must be completed within 6 months, unless it forms part of a larger building project, in which case it may follow the same completion timeframe as the associated works.

If construction is underway but unlikely to be completed within the approved timeframe, the owner may apply to the relevant building surveyor for an extension. Granting an extension is at the building surveyor’s discretion.

Work must cease immediately if the building permit lapses.

During this period, the owner is responsible for ensuring the pool or spa does not pose a risk to life or safety. A compliant safety barrier must be maintained at all times, which may include installing a compliant temporary fence. Owners should seek advice from their building surveyor or local council regarding their specific situation.

To continue construction, the owner may apply for a new building permit from the same building surveyor.

If construction has not commenced and the project will not proceed, the owner must notify both the BPC and the local council that the work has been terminated.

Once the pool or spa is completed, it must be registered with the local council. The owner must also arrange for the safety barrier to be inspected by a qualified professional and provide the resulting compliance certificate to council.

Failure to register a pool or spa may result in significant fines.
